General Terms and Conditions of Sale of Gift Vouchers

The Provider will retain your personal information only for the minimum period necessary to fulfill the purposes set forth in this Privacy Statement, unless in the resolution of disputes or if a longer retention period is required by law. Privacy provisions for the consumer/user of the gift certificate.

RestoManager (hereinafter "The Provider") considers ensuring privacy and data protection very important. With this privacy statement (hereinafter "Privacy Statement"), the Provider wishes to inform the user in detail about the processing of his/her personal data and corresponding rights when using the website www.restomanager.net and www.restotakeout.com.

By using certain functions of the Website, the Provider receives your personal data, which it will process with respect for the privacy of the user and in compliance with the law of December 8, 1992 on the protection of privacy with respect to the processing of personal data (https://www.privacycommission.be/nl/privacywet-en-uitvoeringsbesluiten) which will be replaced by the (European) General Data Protection Regulation ("AVG" but better known under the "GDPR") (http://eur-lex.europa.eu/legal-content/NL/TXT/?uri=CELEX:32016R0679) as of May 25, 2018.

By accepting the extended privacy statement, a general consent is given to all processing operations described in this privacy statement for which consent is required.

General provisions for the consumer/user of the gift certificate.

1. The gift certificate entitles the customer to the amount stated on the gift certificate and paid prior to receiving the certificate. RestoManager is not responsible for the goods or services the customer pays for with the purchased gift certificate.

2. The gift certificate may be redeemed within one year of purchase on the day and time of choice at the restaurant from which the gift certificate was purchased. Under no circumstances and under no circumstances can the consumer exchange the purchased gift certificate to RestoManager for money. The gift certificates are only valid until the date stated on the gift certificate - typically this is 1 year after purchase. The gift certificates are valid only at the merchants currently mentioned on the gift certificate.

3. The prices mentioned on the gift voucher are expressed in euros and entitle you exclusively to the package mentioned on it. On the check is no VAT applicable.

4. The value of a gift certificate cannot be exchanged for money, only for products / services. When using the gift card for products/services with a lower value than the value of the gift card (for example, buying for 30 EUR with a gift card of 50 EUR), the difference cannot be refunded in money. However, a residual value remains on the gift card that can be used later and only in the restaurant where the gift card was purchased.

5. The consumer must keep the gift certificate carefully. Under no circumstances can RestoManager be required to produce a duplicate of the purchased gift certificate.

6. RestoManager is not responsible if the customer enters a wrong e-mail address of the Beneficiary. Furthermore, RestoManager bears no responsibility if the gift certificate falls into the hands of a third party after it has been sent, accidentally or otherwise.

7. RestoManager is not responsible for problems with payment execution by the Customer. RestoManager employs the professional services of Mollie for this purpose to ensure the security of online payments. The Customer does not have the right to cancel the purchase once payment has been completed.

8. RestoManager is under no circumstances responsible for refunds from restaurants or businesses that have gone out of business, making it impossible to use gift certificates.

Nor will RestoManager be obliged to supply a new gift certificate to the consumer, nor to reimburse the cost of a lost/stolen/damaged or unauthorized used gift certificate in any form whatsoever. In other words : the gift certificate is downloadable once with no exceptions. Expired vouchers cannot be refunded to the consumer/user. Even if a restaurant fails or no longer cooperates with RestoManager , RestoManager cannot be held responsible for issuing a new gift voucher for that same restaurant or any other restaurant.

RestoManager reserves all rights in this regard.

In case of deception, fraud, forgery, swindle or other actions performed in bad faith or a suspicion of any of the aforementioned actions, RestoManager is entitled to cancel the purchase of the gift certificate or suspend the execution of the gift certificate, without payment of any compensation.

8. Any infringement will result in total exclusion from the www.RestoManager.net website in its entirety. Any violation of criminal law will be reported by RestoManager to the competent authorities without delay.

Final provisions - Exoneration

RestoManager makes all reasonable efforts to provide accurate and current information on the website www.restomanager.net and on the release of the gift certificate. All information shown on the website is subject to express reservation of printing or other errors.

RestoManager cannot be held liable for any damage resulting from inaccuracies or incompleteness in the information offered on the gift certificate and/or on the website www.restomanager.net or other websites of companies where gift cards are traded through RestoManager.

RestoManager makes every effort to keep the web application and/or gift voucher modules online and cannot be held liable for possible technical failures due to the Internet or the Internet provider nor for the person wishing to purchase a gift voucher nor for the restaurant offering them.

RestoManager exonerates itself for any damage resulting from the use of data, advice or ideas provided by or on behalf of RestoManager through the RestoManager.net website or websites of users of the gift card module.

The RestoManager website (www.restomanager.net) may contain hyperlinks and references to other websites. Such hyperlinks and references are only included for information purposes for consumers and customers. RestoManager accepts no responsibility and cannot be held liable and liable for any kind of damage resulting from the content of the website that can be visited or referred to via a hyperlink.
